Tricycle/Pedicab Fare Increase Guidelines

ORDINANCE NO. 0403 s. 2006
(PROPOSED ORDINANCE NO. 1125)

AN ORDINANCE PROVIDING THE GUIDELINES IN THE IMPLEMENTATION OF FARE INCREASE FOR TRICYCLES AND PEDICABS FOR HIRE OPERATING IN CALOOCAN CITY.

WHEREAS, by virtue of the powers granted to the Sangguniang Panlungsod pursuant Section 458 (3) (vi) of the Local Government Code of 1991, it is the power and authority of the Tricycle & Pedicab Franchising Board (TPFB) to effectively regulate the fare demanded by the tricycles and pedicabs operating within the jurisdiction of Caloocan City from the riding public;

WHEREAS , the various TODA Association in various petition letters submitted to the Tricycle and Pedicab Franchising Board [TPFB] has petitioned for a fare increase as early as December 2005;

WHEREAS, in a public meeting called for the purpose representatives of the various TODA and PODA associations has presented their petition in view of the rising cost of living, maintenance and spare parts and other inputs in their
Operation as Tricycles and Pedicabs for Hire;

WHEREAS, neighboring towns and cities in particular, Quezon City, Malabon, Navotas and Valenzuela has also already granted fare increase to their TODA and PODA associations.

NOW, THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED by the
Sangguniang Panlungsod, in session duly assembled, that:

SECTION 1. Tricycle and Pedicab Fare

1.1 The Fare for Tricycles and Pedicabs for hire operating in the territorial
jurisdiction of Caloocan City shall be as follows:

Tricycle Fare for every Passenger for the
1st KILOMETER or a portion of it: P 6.00
Additional Fare for every 500 Meters or Half [1/2]
Kilometer additional distance for every P 0.50
Passenger

Pedicab Fare for every Passenger for the
1st 500 METERS or a portion of it P 4.00
Additional Fare for every 500 METERS or Half [1/2]
Kilometer additional distance for every P 0.50
Passenger

1.2 A corresponding signage / fare schedule shall be prepared and issued by the Tricycle and Pedicab Regulatory Service [TPRS] to the individual Tricylce and Pedicab for Hire indicating the new fare for tricycles as stated above:

All Tricycle and Pedicab Drivers are strictly enjoined to place the corresponding Fare Increase signage/schedule issued by the TPRS in their
respective units that is easily visible to the passengers.

1.3 All tricycle and pedicab drivers are prohibited from charging the fare
equivalent to three [3] passengers for only one [1] passenger.

1.4 All TODA and PODA Presidents and their duly designated official within
the territorial jurisdiction of Caloocan City are hereby required to post in their respective/designated terminals the new tricycle fare.

SECTION 2. Prohibited Acts

2.1 Non posting of the corresponding signage / fare schedule in the tricycle and pedicab units bearing the new fare;

2.2 Charging of exorbitant fees other than those lawfully prescribed by the
Tricycle and Pedicab Franchising Board;

2.3 Non-compliance with the succeeding kilometer requirement before
additional fare will be charged in accordance with the provision of this Ordinance.

SECTION 3. Penalties

Any Tricycle or Pedicab operator and driver caught violating this
Ordinance shall be liable for the following penalties, to wit:

1st Offense - Fine of Five Hundred Pesos [P500.00]

2nd Offense - Fine of One Thousand Pesos [P1,000.00]

3rd Offense - Fine of Two Thousand Pesos [P2,000.00]

or thirty [30] days imprisonment or both at the
discretion of the court.

SECTION 4. Repealing Clause.

All provisions of existing laws, orders and regulations contrary to or
inconsistent with this Ordinance is hereby repealed or modified
accordingly.

SECTION 5. Separability Clause.

If any part, section or provisions of this Ordinance shall be held invalid or
unconstitutional, no other parts or section for any reason/s any part or
provision hereof shall be affected hereby.

SECTION 6. Effectivity Clause. This Ordinance shall take effect within fifteen [15] days following its enactment and approval.
